According to the Journal of American Medical Association ( JAMA), medical malpractice is “the third leading cause of death in the US, behind heart disease and cancer.” In 2012, there is “over $3 billion that was spent in medical malpractice payouts and averaging one payout every 43 minutes.” Medical malpractice occurs when a health care provider deviates from the recognized “standard of care” in the treatment of patient. The standard of care is defined as what medical provider would or would not have done under same or similar circumstances. In addition, it is estimated that medical errors “kill roughly 200,000 patients in the US each year. However, only 15% of personal injury lawsuit files annually involve medical malpractice claims, and more than 80% of lawsuits end with no payment to injured patient or their survivors.
